These terms and conditions (“Terms”) apply to the use of the website www.printedart.ink (“Website”) and the purchase of any products on the Website. By accessing the Website and/or purchasing products on the Website, you agree to be bound by these Terms.
- INFORMATION ABOUT US
The Website is owned and operated by PrintedArt.ink (“we”/”us”/”our”), a sister company of Bennetts Designation with our registered office at Unit 2, Rear of 55 Comet Way, Southend, Essex SS2 6XR.
- USE OF THE WEBSITE
2.1 You may access the Website for your own personal and non-commercial use only. You may not use the Website for any commercial purposes or on behalf of any third party.
2.2 You may not use the Website in any way that causes, or is likely to cause, the Website or access to it to be interrupted, damaged or impaired in any way.
2.3 You must not use the Website for any illegal or unauthorised purpose or engage in any activity that infringes the rights of others.
2.4 We reserve the right to modify or withdraw, temporarily or permanently, the Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website.
- PRODUCT DESCRIPTIONS
3.1 We have made every effort to display the products on the Website as accurately as possible. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery.
3.2 All sizes and measurements of products are approximate. We have made every effort to ensure they are as accurate as possible.
- PRICING AND PAYMENT
4.1 All prices are inclusive of VAT and exclude delivery costs, which will be added to the total amount due as set out in our Delivery Information.
4.2 We reserve the right to change the prices of any products at any time without prior notice to you.
4.3 Payment can be made by credit card or any other payment method specified on the Website.
- DELIVERY
5.1 Delivery charges and estimated timescales are set out in our Delivery Information.
5.2 We will make every effort to deliver your order within the estimated timescales, however, delays are occasionally inevitable due to unforeseen factors. We shall be under no liability for any delay or failure to deliver the products within the estimated timescales.
- RETURNS AND CANCELLATIONS
6.1 If for any reason you are not satisfied with your order, you may return it to us for a refund or exchange within 14 days of receipt, subject to the terms and conditions set out in our Returns and Cancellations Policy.
- OUR LIABILITY
7.1 Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
7.2 We shall not be liable to you for any indirect, special or consequential loss or damage, loss of profits, revenue, data, goodwill or anticipated savings, whether based in contract, tort (including negligence), breach of statutory duty, or otherwise.
- GENERAL
8.1 These Terms shall be governed by and construed in accordance with the laws of United Kingdom, and any disputes will be subject to the exclusive jurisdiction of the courts of United Kingdom.
The seller ensures that the goods received by the customer are free of defects. At the time of acceptance of the goods, the seller is responsible for ensuring that:
a) The goods have the characteristics agreed upon by both parties, and if there is no agreement, they should have the characteristics described by the seller or manufacturer, which the customer would expect based on the nature of the goods and advertising.
b) The goods are suitable for the purpose stated by the seller for their use or for the typical use of goods of this type.
c) The quality or design of the goods corresponds to the contracted sample or model, if quality or design was determined according to the sample or model.
d) The goods come in the appropriate quantity, measure, or weight.
e) The goods comply with the requirements of legal regulations.
Note that the colour of photographs and images on the customer’s monitor may differ from the resulting inks on the delivered goods, and such a colour deviation is not a defect.
If a defect is noticed within six months of receiving the goods, it is assumed that the goods were defective at the time of receipt.
The customer does not have the right to defective performance if they knew before receiving the goods that they were defective or if they caused the defect themselves.
- QUALITY AND COMPLAINTS
When guaranteeing the quality of goods, the seller promises that they will be suitable for their usual purpose for a specific period or maintain their typical properties.
If a customer is a consumer, they have the right to make a claim for a defect that occurs within 30 days of receiving the goods. For a customer who is an entrepreneur, this applies within 1 month, unless otherwise stated. However, this right does not apply to:
a) goods sold at a lower price due to a defect for which a reduced price was agreed upon.
b) wear and tear caused by normal use.
c) a defect that corresponds to the degree of use or wear in the case of a used item.
Claims for defective performance and complaints should be filed with:

The seller will make a decision on the complaint immediately, or in complex cases within 5 working days. Complaints, including those regarding the elimination of defects, will be handled by the seller without undue delay, no later than 30 days from the submission of the complaint.
The rights from the liability for defects of goods, for which the quality guarantee applies, will expire if they have not been exercised within the specified period.
In the case of resolving a complaint through an exchange of goods, a new period does not start, and the relevant period begins on the day the customer receives the goods.
- Dealing with Defects and Complaints
If the goods have defects as per Article 8 or if the quality guarantee applies within the specified timeframes under Article 9, the customer can:
a) Request new goods without defects, unless this is disproportionate considering the nature of the defect. If the defect only concerns a part of the goods, the customer can only request the replacement of that part. If this is not feasible, they can withdraw from the contract.
b) If rectifying the defect is possible without undue delay, the customer has the right to free-of-charge rectification of the defect. Even in the case of a remediable defect, the customer can request new goods or have the defective parts replaced if they cannot use the goods correctly due to the recurrence of the defect after repair or a larger number of defects. In such cases, the customer also has the right to withdraw from the contract.
c) Request a reasonable discount if they do not withdraw from the contract, or if they do not exercise the right to receive new goods without defects, replacement of parts, or defect rectification. The customer is entitled to a reasonable discount even if the seller cannot provide new goods without defects, replace their part, or repair the item. This also applies if the seller fails to arrange a remedy within a reasonable time, or if doing so would cause significant difficulties.
- Pricing and Offer Validity
The prices of all goods and services advertised include VAT and all other fees required by law at the time of purchase. However, the cost of delivery varies depending on the chosen method, transport provider, and payment method.
A proper tax document is provided with the purchase of goods.
All prices, including promotional prices, are valid until the goods are sold out or until the seller recalls them.
The original price, which is typically crossed out on the website as part of the discount information, refers to the lowest price at which the seller offered the goods in the 30 days preceding the discount. This calculation does not consider individual price advantages or price advantages not automatically included in the current selling price, such as discount codes. The original price remains valid even if the goods are discounted multiple times over a shorter period.
- Discounts and Vouchers
The seller offers various types of discounts such as loyalty discounts, volume discounts, and discounts for recommending friends. Each discount has specific rules for its use.
If a discount or voucher is applied in violation of its rules, the seller reserves the right to refuse such application. In such cases, the customer will be informed and given the option to proceed with the order without the discount or voucher.
The following are examples of violations:
a) The discount voucher is used for goods other than those for which it was intended.
b) The discount voucher is used in conjunction with another discount, even if the aggregation of these discounts was not expressly prohibited.
c) The discount voucher is used for purchases that do not meet the minimum price threshold.
d) The discount voucher has already been used.
The rules and conditions for applying a specific discount are either attached directly to the discount (in the form of information) or are available via a link to the online shop page where the rules of the discount are described in detail. Unless explicitly stated otherwise, each discount or coupon can be applied only once.
If a customer who is not a consumer applies for a discount that does not concern a purchased gift voucher, the seller has the right to refuse such a discount or voucher.
If the value of a gift voucher or discount voucher is higher than the value of the entire purchase, the remaining balance is not transferred to a new voucher or coupon, and the unused amount is not reimbursed.
- Customer Reviews
The seller reserves the right to publish customer reviews that are voluntarily provided by the customers, and have actually purchased the goods. The reviews can only be posted in connection with the purchased goods, to ensure the authenticity of the reviews.
The seller prioritises publishing reviews that do not require any further resolution by customer support and have a verbal rating. The overall satisfaction rating is determined by all customer reviews received, and the seller does not remove any reviews.
- Personal Data Protection
The Seller ensures that all personal data provided by the customer will be handled in compliance with Data Protection Act 2018, on the Protection of Personal Data. The data will not be shared with third parties or entities without the customer’s consent.
Customers may request changes or deletion of their personal data at any time by sending an email to the Seller. For more information, please refer to the Privacy Policy.
- Conclusion
Once the customer’s order is delivered to the seller, it is archived as a proposal for the purchase contract for the purpose of fulfilling and recording the order’s status, which is accessible to the customer.
Any relationships and disputes arising from the purchase contract will be exclusively resolved in accordance with the laws of the United Kingdom, and the competent courts of the United Kingdom will handle such disputes. The United Nations Convention on Contracts for the International Sale of Goods (CISG) will not be applicable, as per Article 6 of the Convention.
These General Terms and Conditions, along with their components, are valid and effective starting from April 19th, 2023, and supersede the previous version of the Terms and Conditions, along with their components.
